The service

FluXence is a Shopify app published by PREDIWORKS. It sends reorder reminder emails to the customers of the stores that install it, on behalf of those stores.

Your account

You use FluXence through your Shopify store. You are responsible for the settings you choose, the content of the texts you customise and the discount codes you offer.

Your obligations

You confirm that you are entitled to email your customers and that you collect their marketing consent in accordance with the law that applies to you. FluXence only emails customers whose marketing consent is recorded in Shopify.

Plans and billing

The plans, their prices and their monthly reminder limits are shown on the plan page in Shopify. Billing is handled entirely by Shopify, on your Shopify invoice. You can change or cancel your plan at any time from that page; uninstalling the app ends the subscription.

Data processing agreement

This section is the data processing agreement between you (the controller) and PREDIWORKS (the processor), within the meaning of Article 28 of the GDPR. It applies as soon as you install the app.

Subject and duration: sending reorder reminders to your customers and measuring their results, for as long as the app is installed on your store. Data processed: your customers' first name, email address, language and email marketing consent, their orders (date, amount, products and quantities) and the history of their reminders. Data subjects: the customers of your store.

Instructions: we process this data only on your documented instructions, which are the settings you choose in the app and these terms, and for no purpose of our own. We do not sell it and do not use it for advertising.

Confidentiality and security: access is limited to the people who operate the service, who are bound by confidentiality. Data is encrypted in transit and at rest, production and test data are separated, access is protected by strong authentication, and backups are encrypted.

Sub-processors: you authorise the sub-processors listed in the privacy policy (hosting, database, email delivery, network protection). We impose equivalent data protection obligations on them, remain responsible for them, and will announce any change on the privacy policy page before it takes effect, so that you can object by uninstalling the app.

Location: the data is hosted in the European Union. If a sub-processor were to process it outside the European Economic Area, this would be done under the safeguards required by the GDPR, such as the European Commission's standard contractual clauses.

Assistance: we help you answer requests from your customers exercising their rights. Access and erasure requests sent through Shopify are handled automatically; for anything else, write to [email protected].

Personal data breach: if we become aware of a breach affecting your customers' data, we notify you without undue delay, and within 72 hours at the latest, with the information you need to meet your own obligations.

End of the service: when you uninstall the app, your store's data and your customers' data are deleted, as described in the privacy policy. While the app is installed, orders and reminders are deleted 24 months after their date.

Information and audits: on request, we provide the information needed to demonstrate compliance with this section and answer reasonable audit questions.

Availability

We work to keep the service available and reminders delivered on time, but we cannot guarantee that every email reaches its recipient: delivery also depends on email providers. A reminder that could not be sent on time is dropped rather than sent late.

Liability

The service is provided as is. To the extent permitted by law, our liability is limited to the amounts you paid for the service over the twelve months before the event giving rise to the claim.

Ending the service

You can stop using FluXence at any time by uninstalling the app; your data is then deleted as described in the privacy policy. We may suspend a store that uses the service to send unlawful or abusive messages.
